Women on the Talking Points and Demands on the Constitution 

The National Association of Non-Governmental Organisations (NANGO) facilitated Civil Society Cluster Consultative Meetings on the ongoing constitutional reform process from 27 to 29 April 2010. The meetings were attended by 712 delegates representative of the various stakeholders within civil society actively participating on the constitutional reform process.  

Talking Points

Women Groups expressed strong reservations concerning the proposed talking points that the Constitutional Parliamentary Select Committee (COPAC)’s intends to use during the outreach meetings, which have they described as prescriptive and suggestive hence probabilities are high that the output thereof shall not adequately represent the will and intention of the people of Zimbabwe. Further concern was expressed regarding the technical language used in drafting the talking points as this will elude the layman’s scope.

Women Groups are extremely concerned about the existing gaps within the talking points; key issues affecting the rights of women and equality before the law, as well as humanitarian assistance to the most vulnerable persons are not adequately addressed. The delegates observed that COPAC had not consulted key stakeholders, including civil society, hence the resultant gaps that have been identified in the talking points. We therefore call for broader consultations on the talking points before these are finalised by COPAC.

Key Demands
Women Groups reiterated that their demands for a minimum of 52% representation in the leadership of political, socio-economic aspects of public life; this can be achieved thorough implement the zebra principle in all key appointments. Women groups demand equality in terms of opportunities, and mainstreaming of gender issues into the constitution making process.

The operational environment is currently not conductive for the outreach teams to conduct their work. Delegates were gravely concerned that the majority of our people will not be able to freely contribute to the drafting of the new constitution in the existing polarised environment. Women are exposed to great security risk in the constitutional making process such as rape due to the highly polarized environment. There is overwhelming evidence of ongoing systematic harassments and intimidation of women in order to stifle them from contributing during the outreach process hence the mostly men will be leading in making submissions on content of the constitution.

The National Association of Non – Governmental Organisations (NANGO) calls upon the inclusive government to immediately attend to the legislative agenda to ensure that a conducive environment, with security of women being observed as paramount, and should be guaranteed for this critical national process; Selective application of the law through application of restrictive legislation such as the Public Order and Security Act (POSA) and Access to Information and Protection of Privacy Act (AIPPA) need to be urgently attended to in order to ensure that all citizens are able to participate in this national process  It is therefore imperative to address the issues of concern regarding the talking points and the operational environment before embarking on the outreach phase.

PEACE DAY PROTEST – 25 July 2009

ROHR ZIMBABWE HAS PLANNED A PROTEST MARCH SCHEDULED FOR TOMORROW SATURDAY 25 JULY 2009. PEOPLE WILL BE WEARING BLACK IN PROTEST AND ALSO IN SOLIDARITY WITH VICTIMS OF POLITICAL VIOLENCE. WE INVITE EVERYONE TO COME AND PARTICIPATE IN THE ACTION. 

ROHR Zimbabwe also invites you to wear black on 24,25,26 July in protest at  the eclipse of peace in Zimbabwe and to remember our fellow countrymen who lost lives, property and homes in the political violence that preceded the June 27 sham elections 

We are aware of the indaba that took place at the rainbow towers where the three political party leaders, President Mugabe, Prime Minister Morgan Tsvangirai and DeputyPrime Minister Arthur Mutambara addressed the nation celebrating Zimbabwe’s ‘new found peace and unity’ As ROHR Zimbabwe we disagree with the Government’s objective which is to urge people to forgive and forget the previous human rights crimes while trotting away from the real need for truth, justice and compensation for victims. This is obviously ZANU PF’s idea because it protects them from prosecution and the need to be accountable to what their crimes.   

We believe that peace is likely to remain elusive as long as the status quo described below continues.
·   Violence against MDC supporters continues.
·   Threats of violence issued by war veterans and ZANU PF thugs against civil society organizations that disagree with the use of Kariba draft as the basis for constitutional reform in
Zimbabwe.
·   Continued armament and mobilization of militia and youths in rural areas.
·   Violent invasion and disrespect of property rights at farms around the country at the government’s instigation.
·   The state controlled newspapers, television and radio stations continue broadcasting party propaganda and lies at the expense of the truth.
·   Those who committed human rights crimes and other atrocities continue to be protected by the state, while the attorney general relentlessly harasses victims of state abductions. To this we refer to human rights activists, journalists, and MDC members abducted and tortured late 2008 on trumped up charges.
·   As long as the political parties in the inclusive Government remain mistrustful of each other and maintain the logjams preventing full implementation of the Global Political Agreement (GPA) and subsequently inviting SADC to solve their problems.
·   As long as the police enforce the law partially depending on who has committed the crime, with those belonging to ZANU PF getting favorable treatment than others.
·   As long as the government views human rights and democracy as western ideologies those threaten the Nations unity and sovereignty.
·   The supporters of ZANU PF idol the use of violence as a trade mark of patriotism and tools of recognition and heroism within the party structures.
·   As long as Mugabe and his bigwigs responsible for various human rights crimes do not publicly admit wrong doing and apologize for the role they played in the Gukurahundi massacre, Operation Murambatsvina, 2008 inter-elections violence and the blood diamonds terror in Chiyadzwa.

PRESS STATEMENT: ROHR ROARS AGAINST MUGABE  

In an extraordinary government gazette Robert Mugabe declared that 24-26 July will be a period for all Zimbabweans at home and abroad to 'renounce and report all forms of political violence, in an effort to ‘restore peace and stability in the country'. Therefore the days have been declared National Peace days for renouncing political violence and promoting national healing. At a glance the idea seems to be noble and peculiar, but subjected to further scrutiny the context of the call ebbs all the confidence we had in the sincerity of both the office and the person of President Robert Mugabe.  

ROHR Zimbabwe is horrified at the dishonesty of the inclusive government and has no faith in the genuineness of Robert  Mugabe’s initiative in declaring 24 – 26 July national peace days. ROHR will be taking to the streets tomorrow (24th July) to protest against this cover-up and demand truth, justice and transparency from the inclusive government. 

Below is ROHR’s commentary on the government’s new initiative. 

Firstly for peace to prevail in any given nation, the state should be totally transformed into a safe house for every individual. The powers of the state to carry extra-legal mandates such as militia and para-militia activities against its people should end. The state should lead its citizenry and fulfill its duties under the spotlight of sacrosanct values, ideas and legal instruments that ensures that the bill of rights is elevated to a supreme position that becomes the campus of how the populace and the state interact.  

This has not happened in present day Zimbabwe, because that the police, state intelligence and other arms of the executive are still carrying out extra-legal activities with impunity. The people of Zimbabwe’s safety remains severely endangered.  

That we are coming from a dark age of reprisal and state sponsored human rights violations and organised state acrimony on those holding dissenting views is undisputable. What is dismissive from our side is an attempt by the present day government to create symbolic days and moments in our country where by the people, region and the international world are misled to believe that the incumbent is whole heartedly moving the country from the abyss of terror towards a glimpse of light and peace.   

Peace in its totality is a function of political will and maturity on those who are holding public office and the people of Zimbabwe at large believing that proper mechanisms of truth and reconciliation have been met. Only after those who were grieved acknowledge that restorative measures have been done and those who would have committed acts to terror acknowledging that they violated other people’s rights could peace as a concept be fully recognized. Mr. Mugabe cannot be the agitator of violence and define peace at the same time, as if he holds the rod of making the rule as he goes. 

One will be forgiven to imagine that the person who boasted of degrees in violence not so long ago, can easily sublimate the ‘ideas’ of war and the funning of violence in a blinker of an eye. We remain cognizant of the need for national healing, but at the same time the concept of national healing should be holistic by mainly addressing the following fundamental issues:
·         The state should be separated from political parties, that is to say, Zanu PF should disband its infrastructure of violence and its proxies. This is in light of the tidal wave of violence which erupted at the Rainbow Towers, instigated by the ZANU PF hoodlums and buttressed by its public relations outfit, Zimbab0we Broadcasting Cooperation.
·         The uniformed forces should start to behave accordingly with the spirit and letter of co-existence to ensure that lasting peace is equally attained.
·         The state broadcaster should desist from funning hate speech and lies aimed at prejudicing the public against civil society organizations and other political parties apart from ZANU PF.     
·         The state should immediately cease harassing human rights and political detainees within and without the Zimbabwe prisons.
·         ZANU PF should demobilize and disarm the militia, the proxies of violence that are still active since the acrimonious epoch of political terror that claimed more than 180 lives and displaced thousands in 2008.
·         Known perpetrators of violence must face the law regardless of political affiliation and rank in society.
·         The state should immediately stop violence happening at the farms and respect the ruling made by the SADC tribunal disputed of farms in 2008. 

Put differently, peace can never be wished into existence by mere words and public relations stunts as the Organ on National healing, Reconciliation and Integration would have the nation believe. The stark reality is that peace will remain elusive in Zimbabwe as long as the political parties are only as prepared as to condemn violence through the media yet leave institutions and infrastructures of violence in position for further instructions. Furthermore war veterans continue to be violent with the protection of the police and the public broadcaster as evidenced by the recently disrupted conference at rainbow towers hotel. The reports made by MDC of violence against its supporters even after the advent of the inclusive government are equally worrying. Without taking concrete steps towards restoring the rule of law, disbanding militia camps, and other recommendations stated above, the call for observing three days to ‘celebrate Zimbabwe’s newfound peace and unity’ remains what it really is – a bluff!

ROHR Zimbabwe comments on the disrupted “All stakeholders” conference

The most colorful display of the constitutional discord was witnessed on Monday 13 July when delegates at the “All stakeholders” conference saw the petal of confusion, deception and violence cascading down to the center stage, effectively blowing the runway light bulbs when the constitutional plane was just about to land. The level of disorganization and the consequential impression emanating from the just landed indaba fails to justify the commitment and faith placed by relevant stakeholders in the parliamentary led constitutional initiative. 

ROHR Zimbabwe is a huge supporter of people driven and democratic processes and therefore stands opposed to the current process led by the parliament. Article 6 of the Global Political Agreement (GPA) which gave birth to the parliamentary steered constitutional process makes a mockery of the constitutional reform process in Zimbabwe as it relegates civil society to an observer role with little influence while awarding the primary political parties ample room and opportunity to manipulate the document for political gain. It preclude other political players from participating and reduces civil society to mere spectators with an insignificant muscle to manoeuvre meaningfully.

Albeit predictable, the disruption of the Indaba by hired ZANU PF thugs is a statement not only of the fact that the former revolutionary party  has not yet repented, but that politicians see the constitution as yet another bargaining tool of sealing deals of the interparty negotiations that began in 2007. Installing the usual infrastructure of violence at the starred hotel facilities to disengage any gears of progress casts serious questions on the wisdom of bestowing an exercise of this importance in the hands of politicians, particularly these primary parties currently involved in tugs and negotiations for political grip in the government. Obviously the drafting of the constitution is yet another tool necessary to create and/or strengthen party stake in the Government in preparation for the impending elections. We seriously question their credibility to be at the forefront of this agenda. 

ROHR Zimbabwe firmly believes that any reform of the Zimbabwe constitution should be people driven and not parliamentary driven. The secretive nature of political negotiations gave birth to the controversial draft doctored at the resort town of Kariba in September 2007, and the GPA in September 2008, both of which are political deals kept away from public scrutiny and participation to the detriment of popular input. There is little doubt that the insertion of Kariba draft in the parliament led process as referenced in article 6 of the GPA is a well orchestrated campaign by the primary negotiators to protect their political interests. If the draft is to be used as the basis for constitution-making in the country, Zimbabweans will be denied their right to write a constitution for themselves. The draft is seriously flawed. It sneaks in weak aspects of the current constitution and that of the rejected constitutional commission draft that was reject by the people in 2000, thereby producing an unacceptable government with unchecked executive powers, a weak parliament, and inadequate protections for fundamental rights and freedoms.

Therefore Restoration of Human Rights Zimbabwe reiterates its position that we will not participate in the process in its current form because we believe it is not people driven and runs the risk of political manipulation. By stating the following ROHR Zimbabwe is only reiterating the position we took in 2008 and the views expressed in the People’s Charter that the people should be allowed to write their own constitution in a free, transparent and participatory way and this can be achieved through creating an independent inclusive All Stakeholders Commission to run the process.  

Furthermore our non-participation approach stems from prior knowledge of President Mugabe and his colleagues in ZANU PF  who pride on a culture and history of violence and politics of coercion in the agency of youth militia, ex-combatants and the passive or active cooperation of national institutions such as police, army and Central Intelligence Organization. Despite his verbal commitment to power sharing in a coalition Government with MDC, Mugabe is yet to demonstrate  policy and attitude shift from this culture and the recent disruption of the constitutional conference only strengthens this fact. What we observe is Mugabe’s continued intransigence as shown by his keenness to ignore all stakeholder rejection of the Kariba Draft which we all agree fails to protect anything else except enormous and sweeping powers for the President while underplaying the importance of checks and balances derived from judicial independence and strength of parliament.

As a progressive movement, we will not stop anyone who wants to participate or observe the proceeding of the constitutional process led by the Parliamentary Select Committee. Our position will however remain as that enunciated before that ROHR Zimbabwe will not participate in a process we do not believe will produce the result necessary to solve current constitutional and human rights challenges that catalysed Zimbabwe into a gigantic human rights furnace, exposing her citizenry to the worst economic and social dragons unprecedented in the history of the nation. 

Justice for all of us, the will of the  people shall prevail

Press Statement from ROHR ZIMBABWE – 24th June 2009

Restoration of Human Rights (ROHR) Zimbabwe is deeply disturbed by a vicious, hate-fuelled and well-orchestrated campaign by some UK-based Zimbabwean online newsites aimed at discrediting ROHR Zimbabwe as an organisation and the personal integrity of Ephraim Tapa, its President. Chief among these are Nehanda Radio, Zimdaily and ZimEye. Articles on these newsites have accused ROHR Zimbabwe and its President of masterminding a spontaneous response from Zimbabweans to the Zimbabwe Prime Minister, Mr Morgan Tsvangirai’s call for Zimbabweans in the diaspora to ‘come back home’. ROHR Zimbabwe and its leadership wants to disassociate itself from these malicious accusations as they are baseless and outright falsehoods. We also want to state categorically that at no time did the organisation agree, let alone set an agenda to ridicule or disrupt the Southwark Cathedral meeting. Mr Tapa was not even at the meeting. We therefore dismiss the accusations with the contempt they deserve. 

Why did the people boo the Prime Minister? Watching the online video clips, it is clear to see that the PM is loudly applauded at one point followed by a somewhat subdued reaction as he continues his speech, finally to be greeted by a spontaneous, deafening chorus of ‘Chinja!, Chinja! Mugabe must go!’ Truly this was not the work of Mr Ephraim Tapa or ROHR Zimbabwe and neither was it the work of its sister organisation, the Zimbabwe Vigil. To suggest so is to pour contempt on the conscience of the people of Zimbabwe whom we so respect. To launch this campaign on so little evidence mean that elements in the Zimbabwean UK Diaspora must feel very threatened by us as our message continues to reasonate with not only those in the Diaspora but also the wider constituency within Zimbabwe.  The issue is that Zimbabwe is still not safe to return for those who fled persecution and are in need of international protection. ROHR Zimbabwe and the Zimbabwe Vigil does not apologise to anyone for our principled stance that ‘Mugabe Must Go’, our demand for democracy and justice, respect for the rule of law and the Restoration of Human Rights. It is interesting that groups like the Vigil and ROHR who are kept busy by real activism don’t have the time or inclination to decampaign other groups.  

ROHR and its President have been accused of many other crimes in a campaign that dates back to 2007, when the MDC-UK & I Executive, then led by Ephraim Tapa, was dissolved unconstitutionally. At NO time was Mr Tapa ever EXPELLED from the MDC Chairmanship and for the record, he actually declined to stand the second time he was requested to do so. Then, the call was for the Party to uphold its founding principles – constitutional democracy, transparency, accountability and justice for all. The ROHR President continues to cherish those values and, unlike some who have started glorifying Mr Mugabe with the advent of the inclusive government, continues to fight for GENUINE CHANGE. Whilst engaged in this struggle for human rights and notwithstanding his right to do so, Mr Ephraim Tapa does not for now have plans to seek any political office within any political party. And contrary to misleading theories being peddled by those who seek to detract from him, Mr Tapa harbours no rancour or vendetta against anyone within the MDC family. 

The call NOW is for the inclusive government to address human rights concerns, uphold the rule of law and mete out justice to all those who perpetrated human rights abuses, including Robert Mugabe and his cronies. In its quest for these ideals, ROHR Zimbabwe has managed to create in three years a respectable national and international profile. Mindful of the suffering of Zimbabweans, ROHR Zimbabwe filed a lawsuit against Gono to remove cash withdrawal limits, mounted successful demonstrations in demand for justice and democracy, buried and cared for victims of the 2008 Mugabe terror campaign, provided basic necessities to vulnerable groups such as orphanages, the displaced, and disadvantaged school children, to name a few.  We have registered a prominent presence in defence of human rights as we continue to operate legally in Zimbabwe, South Africa and the United Kingdom. It seems ROHR Zimbabwe has become the victim of its success. 

ROHR Zimbabwe runs offices in Zimbabwe, employs staff, runs programmes and assists on humanitarian causes, and like any other organisation, it needs money to do this. As a membership based organisation, ROHR Zimbabwe depends mainly on the support of its membership. Monthly subscriptions are decided and managed as per its constitution and members reserve the right to vary this and determine the direction of the organisation. As an international organisation, ROHR Zimbabwe operates within the legal framework of host countries.  Membership is open to the willing and those who join do so of their free will. 

ROHR Zimbabwe is not a refugee or asylum organisation – it does not have the power to regularise anyone’s stay in any given country. We believe that those in need of international protection can only base their claims on their personal / activist profiles. We are however aware that ROHR Zimbabwe members, their staff, supporters and activists have been persecuted under the Mugabe regime and still continue to face persecution, along with other human rights defenders, under the inclusive government. Therefore, whilst membership of ROHR Zimbabwe or participation at the Zimbabwe Vigil may be helpful, it is important that those who join us do so for what we do: defending and restoring human rights in Zimbabwe and not otherwise.  

ROHR Zimbabwe will continue to stand by the people of Zimbabwe whatever it takes and will not allow itself to be distracted by hate-filled individuals hiding behind the facade of gutter journalism.
